These Terms of Use (“Terms”) govern access to and use of https://secureshreddinganderecycling.com/ (the “Site”), operated by Information Management Solutions LLC, doing business as Secure Shredding & E-Recycling (“SSER,” “we,” “us,” or “our”). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.
1. Site Information and Quote Requests
The Site provides general information about SSER’s shredding and e-recycling services. A contact-form submission, quote request, employment application, or other request through the Site does not create a binding service agreement, service order, booking, payment obligation, or guarantee of service availability, pricing, timing, or scope. No contract for services is formed unless and until we separately agree to it in writing or as otherwise expressly confirmed by an authorized representative of SSER. SSER may contact the requester by telephone or email regarding a quote or request.
2. Permitted Use
You may use the Site only for lawful, personal, or internal-business purposes related to evaluating, requesting, or applying for opportunities with SSER. You may not interfere with the Site’s security or operation, introduce malicious code, attempt unauthorized access, scrape or harvest Site content or contact information for unauthorized solicitation, or copy, reproduce, distribute, modify, or commercially exploit Site content except as permitted by law or with SSER’s prior written permission.
3. Quote Requests and Employment Materials
You represent that information you submit through the Site is accurate and that you are authorized to provide it. Employment applicants may submit a resumé and, if desired, a cover letter through the employment form. Do not submit sensitive, confidential, proprietary, or regulated information through a general Site form unless SSER specifically requests it through an approved process.
4. Payment Link
The Site may provide a link to a Heartland Payment Services page to permit visitors to pay a bill. Payment processing occurs on the third party’s website, not on the Site. Your use of that page is governed by the third party’s applicable terms and privacy notice. SSER does not control the payment processor’s website or practices.
5. Intellectual Property
The Site’s text, design, graphics, logos, photographs, service descriptions, and other content are owned by SSER or its licensors and protected by applicable intellectual-property law. Nothing in these Terms grants ownership of Site content or SSER trademarks. Third-party names, logos, certification marks, and content belong to their respective owners and are used only as authorized.
6. Third-Party Links
The Site may contain links to third-party websites, including payment, review, certification-information, social-media, and other external services. Those links are provided for convenience only. SSER does not control, endorse, or assume responsibility for third-party content, availability, privacy practices, or terms.
7. Reviews and Feedback
We welcome honest feedback. Nothing in these Terms prohibits a consumer from giving a lawful review, assessment, or other consumer feedback. If you submit feedback directly to SSER, you grant SSER a nonexclusive, worldwide, royalty-free license to use, reproduce, display, and distribute that feedback for business purposes, subject to applicable law and our Privacy Policy. This license does not transfer ownership of your feedback.
8. Disclaimers; Limitation of Liability
THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, SSER DISCLAIMS ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. SSER DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SSER AND ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO THE SITE OR THESE TERMS.
TO THE FULLEST EXTENT PROVIDED BY LAW, SSER HEREBY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT, AND FITNESS FOR PARTICULAR PURPOSE.
THE FOREGOING DOES NOT AFFECT ANY WARRANTIES THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
9. Indemnification
You agree to defend, indemnify, and hold harmless SSER and its owners, officers, employees, agents, and service providers from claims, losses, liabilities, damages, and expenses, including reasonable attorneys’ fees, arising from your misuse of the Site or violation of these Terms.
10. Governing Law and Venue
These Terms are governed by the laws of Louisiana, without regard to conflict-of-law rules. Any dispute arising from the Site or these Terms must be brought exclusively in the state or federal courts located in Baton Rouge, Louisiana, and you consent to personal jurisdiction and venue there.
11. Limitation on Time to File Claims
ANY CAUSE OF ACTION OR CLAIM YOU MAY HAVE ARISING OUT OF OR RELATING TO THESE TERMS OF USE OR THE WEBSITE MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES; OTHERWISE, SUCH CAUSE OF ACTION OR CLAIM IS PERMANENTLY BARRED.
12. Waiver and Severability
No waiver by SSER of any term or condition set out in these Terms of Use shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of SSER to assert a right or provision under these Terms of Use shall not constitute a waiver of such right or provision.
If any provision of these Terms of Use is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms of Use will continue in full force and effect.
